The Mines and Geosciences Bureau Regional Office No. 08 has recently deputized different representatives of LGU-Samar and members of the Philippine National Police (PNP) in two batches in response to the request of the Office of the Provincial Environment and Natural Resources Management of Catbalogan, City through a deputation seminar held on April 27, 2022 at Tia Anita’s, Catbalogan City, Samar.
The attendees were oriented about the salient features of RA 7942 and its IRR, permits issued by the Provincial/City Government, Ore Transport Permit/Delivery Receipt/Mineral Ore Export Permit, the City Mining Regulatory Board composition and functions, mandatory requirements for quarry or industrial/commercial sand and gravel permit application and the prohibited acts and the procedures during apprehension/seizure of perpetrators of illegal mining, among others.
Meanwhile, MGB-08, through Atty. Rogelio Napoles, Jr., stated that MGB-08 is likewise grateful that the City Government is intensifying its efforts to police mining operations within its jurisdiction by deputizing mining enforcement officers since the Regional Office has inadequate personnel to monitor all mining operations within the Eastern Visayas region.
Thus, as deputized Mining Enforcement Officers of MGB RO No. 08, they are authorized to conduct apprehension/seizure of perpetrators of illegal mining and the illegal transport of minerals and mineral products within Catbalogan, City.
Questions raised during the seminar by the participants focused on the procedures to be followed on the release of conveyance seized when no case was filed; elements necessary to file a case for theft of minerals, how to make an estimation on the volume of the load of conveyance; period for which to file a case for theft of minerals, where to deposit the seized conveyance and permit necessary for trading and selling minerals.
